While Renee is a huge fan of mediation and amicable divorces in the right circumstances... there are also times when going to trial is a better option. Renee walks us through why it is sometimes better to go to trial. The conventional wisdom is that it's cheaper to settle your divorce because you avoid the costly process of trial. (Hello, attorney's fees!) But if you're giving up too much money on your assets or your support payments, then you could end up in a worse financial position than if you had gone to trial. 

One of the most common financial issues that Renee recommends going to trial on is the pension or the 401(k). Retirement funds are often one of the most valuable assets that couples have when they are getting divorced. It is important that you get your fair share of that asset, and you may not be able to negotiate something fair because your spouse doesn't want you to have any of it. That's when a trial is a good option.
